Abstract

Thesis entitled “The Implementation of Diversion Against Child Suspects of Narcotics Abuse at the National Narcotics Agency of the Special Region of Yogyakarta”. With the rise of narcotics abuse involving children, Diversion is carried out as an effort to protect children in conflict with the law. This study aims to find out how the regulation regarding diversion in Indonesia and the implementation of diversion against child suspects of narcotics abuse. This research is an empirical legal research supported by primary data, secondary data. Primary data is obtained directly from the object, namely conducting interviews with Investigators of the National Narcotics Agency of DI Yogyakarta Province and secondary data consisting of primary legal materials sourced from related regulations and secondary legal materials originating from legal and non- legal opinions obtained from books , journals, internet. Inductive thinking is a way of thinking from a specific knowledge to general knowledge by using reasoning. Based on the results of the research and discussion that the author made, it can be concluded that Diversion is regulated in Law no. 11 of 2012 concerning the Juvenile Criminal Justice System. Regarding guidelines for implementing the Diversion process, the government issued Government Regulation No. 65 of 2015 concerning Guidelines for Implementing Diversion and Handling Children who are not yet 12 (twelve) years old.
