Abstract

The purpose of the thesis entitled THE ENFORCEMENT OF THE DEATH PENALTY FOR NARCOTICS DEALERS IN THE PERSPECTIVE OF HUMAN RIGHTS (STUDY OF PN WEST JAKARTA VERDICT NUMBER 2267/PI. SUS/2012/PN. JKT. BAR DATED JULY 15, 2013 -FREDY BUDIMAN ALS BUDI BIN H. NANANG HIDAYAT) is to understand whether the enforcement of death penalty against narcotics dealers is in accordance with the purpose of execution and Human Rights. Although the imposition of the death penalty has sparked much debate among Human Rights activists, this does not daunt law enforcement officials to continue to strive in the enforcement of death penalty sanctions, especially against drug abusers. Considering the application of death penalty sanctions are still enforced in Indonesia and is still a material law that applies in Indonesia as stipulated in Article 10 of KUHP. The enforcement of the death penalty is expected to be more effective, considering that prison sanctions are no longer effective applied to drug dealers or dealers. Considering the prison sentence can cause opportunities for convicts to become recidivists or even be able to control the narcotics business from within the Penitentiary as has been done by death row inmate Freddy Budiman.
