Abstract
Diversion is the transfer of settlement of children's cases from the criminal justice process to a alternative dispute resolution. The diversion in Article 7 paragraph (2) of Law Number 11 of 2012 concerning the Juvenile Criminal Justice System can be applied to cases of children who are threatened with imprisonment of less than 7 (seven) years and are not criminal repetitions. Meanwhile, Article 3 of the Supreme Court Regulation Number 4 of 2014 concerning Guidelines for Implementing Diversion in the Juvenile Criminal Justice System allows for diversion in the case of a criminal offense punishable by imprisonment of 7 years or more in the form of a subsidiary, alternative, cumulative or combination indictment. The purpose of this study is to determine the position of the Supreme Court Regulation No. 4 of 2014 against Law No. 11 of 2011. The method used in this study is normative which focuses on the problem of existing norms. The results of the study state that the regulation on diversion in the Supreme Court Regulation is an extension of the meaning of the Act. However, in this case the Regulation of the Supreme Court must comply with the provisions of the existing law.
