Abstract

The title of this research is TANGGUNG JAWAB PENGUSAHA BUS PRAYOGO ATAS KECELAKAAN LALU LINTAS AKIBAT PERBUATAN MELAWAN BUKUM PIHAK KETIGA. The law problem in this research was the impropriety between the occurred case with the applied law, especially on the liability. In this case, the existing case was a traffic accident happened between a Prayogo bus and a motorcycle. The motorcycle riders as the third party, while the entrepreneur and the driver of the Prayogo bus as the first and second party. In this case, the party which breaks the law was the third party. Based on the prevailing law regulation, the party who has to be liable was the third party. In the reality, the first and the second parties also have to be liable. This research aims to know how the liability of the entrepreneur of Prayogo bus upon the happening traffic accident as the result of the action of breaking the law of the third party. The method that was used in this research is empirical method, it obtain the data directly in the location of the research. This research was done by interviewing directly the entrepreneur of Prayogo bus and also the employers, the drivers and the driver's assistants of Prayogo bus. The result of this research shows that the entrepreneur of Prayogo bus was involved on the liability by giving the compensation to the motorcycle riders in which the entrepreneur of Prayogo bus should not be liable because the driver of Prayogo bus did not break the law.
