Abstract

This legal research was entitled The Legal Upholding toward the Doer of Hacking Criminal in Indonesia. Based on the background of this legal writing, one of the information-technology developments is internet. As the usual renew of technology, beside internet gives any profits, it also emerges the negative access and the opening the opportunity of technology misusing. Technologies in study hacking also lack of appropriateness, thus the legal upholder apparatus feel difficult in detect the hacking crime. Methodology of this legal writing is normative legal research i.e. the literary legal research of which was conducted by studying literary sources of which is the secondary data. Thus, it could be concluded that hacking is a new kind of crime of which emerged because of the advance of science and technology. Up to now, if there is happened hacking crime, it still uses current legislation of which in fact, this is not purposed to hacking crime. In Criminal Code and Laws on telecommunication it is not founded the glare which specifically rules on the criminal crime of hacking of which includes as the new kind of crime. The advice could be drawn from this legal writing is in order the government as soon as possible substitute the legislation (law regulations) of which handle on the glare of internet crime, especially hacking
