Abstract
Second-hand clothes are prohibited. It is written in Article 2 Minister of Trade Regulations No. 51 of 2021 concerning Prohibition of Imported Second-hand Clothes. Even though it is prohibited, there can be found many businessmen who are still executing it. The problem formulations in this research are; how are the qualifications of second-hand clothes as sales objects in Indonesia and how are the legal obligations of related institution on imported second-hand clothes trading in Indonesia. The methods used in this research is normative juridical law research methods. The result of this research shows that during the supervision of Imported second-hand clothes trading is illegal, the Governor has the right to delegate their surveillance/supervision authority to the Head of Department/the Department Head, wherein the Governor is able to coordinate with the regent/mayor in the area they are assigned to, and in this case, the institution in charge is the Trade Office/Trade Department. If there were suspicions of violation during the process of supervision held by the institution related, there will be criminal sanctions in accordance with the applicable Law
