Abstract

This legal thesis is entitled “Implementation of the use of the coastal border in Hamadi - Holtekamp of Jayapura City based on the Jayapura City Regulation Number 1 of 2014 concerning the Jayapura City Spatial Plan 2013-2033”. The problem discussed was whether the implementation of the use of the coastal border was in accordance with the regional regulation regarding the spatial plan for the Jayapura city area. This legal thesis using the method of empirical legal research conducted directly to respondents namely the cafe owners on the Hamadi - Holtekamp beach border. The research result showed that the implementation of the use of the beach border for cafes is not in accordance with the Jayapura City Regional Regulation Number 1 of 2014 concerning the Jayapura City Spatial Plan because many cafes are standing at less than 100 (one hundred) meters from the highest tide point and the cafes that stands on the coastal border area is also included in the protected forest area. The land is controlled by the local indigenous community by granting a lease permit to the cafe owner. All cafes have a business license in the form of SIUP/SITU but do not have a building permit.
