Abstract

Mining activity at Indonesia based on Law of The Republic of Indonesia Number 4 of 2009 Concerning Mineral and Coal Mining ( Undang – Undang Nomor 4 Tahun 2009 Tentang Pertambangan Mineral dan Batu Bara). One kind of area that used for mining activity is at forest area, which is do with rent use forest system based on Rent Use Forest System Act ( Peraturan Menteri Kehutanan Nomor : P.43/ Menhut-II/ 2008 Tentang Pedoman Pinjam Pakai Kawasan Hutan ). Utilizing of heavy mining equipment only based on environmental study and facibility study without based on licensing mechanism seems like utilizing heavy equipment for forest manufacture. The impact of using the heavy mining equipment to the land is so damage, because it made the soil is not fertilizer again, although the corporation that had the mining permittion has a responsibility to reclaim the forest area after the mining activity over. The supervision for the mining activity is done by Mining Instructor, which is for now it still doesn’t work. The Mining Instructor do the supervision once every 6 months. It make a opportunity for the corporation to manipulate the utilizing of heavy mining equipment.
