Abstract

The criminal act of corruption or what can be abbreviated as Tipikor can be carried out during the Covid-19 pandemic by individuals or officials were carried out very easily. In the criminal act of corruption, death penalty can be applied with the provision that corruption is committed in certain circumstances. Writer in this take on title “Implementation of the Death Penalty Sanction in Prosecutions Against Corruption Offenders in Certain Circumstances (case study: decision no. 29/Pid.sus-TPK/2021/PN.JKT.PST)" was compiled using normative research methods. The Public Prosecutor does not demand the death penalty against the perpetrators of the corruption crime of social assistance Covid-19 in Jakarta. Because the case is a hand-catching operation that began with a bribery case, besides that there are still many unclear regulations in the regulations, and Indonesia is also not ready to face threats from outside due to the application of the death penalty. So that from these results clear regulations are needed so that there are no other interpretations and it is also necessary for prosecutors and judges to be thorough, careful and courageous in prosecuting and making decisions on death penalty in accordance with the applicable law.
