Abstract
The The city of Balikpapan, located in East Borneo, is the second-largest oil refinery city in Indonesia. As an oil refinery city, Balikpapan produces different fuels, such as Premium, Solar, Pertalite, Dexlite, Pertamax, Pertamina Dex, and LPG Gas. Those fuels are manufactured in large amounts by the manufacturer, and it keeps increasing continuously. However, with mass production, the potential negative impact felt by the environment is also high. This issue will be the focus of the thesis. This thesis will discuss various ways to control marine pollution due to oil business activities in Balikpapan City. It will also discuss several barriers faced when restraining the marine-pollution issues in Balikpapan City. This thesis use empirical legal research methods where social facts are the focus of this research. It will also be written based on direct interviews with the Balikpapan City Environmental Service and literature studies on applicable laws, such as the 1945 Constitution of the Republic of Indonesia, Law Number 32 of 2009 concerning Environmental Protection and Management, Government Regulation No.22 of 2021 concerning Implementation of Environmental Protection and Management, and Mayor of Balikpapan Regulation No. 56 of 2016 concerning Organizational Structure, Job Descriptions, and Functions of the Balikpapan City Environmental Service, as well as legal facts, journals, doctrines, legal principles in literature, journals, research results, internet news, and dictionaries related to marine pollution due to activities petroleum business. Based on the research, oil pollution handling in Balikpapan City is still not optimal. The low-handling issue is due to various obstacles faced by the Environment Agency, such as a lack of budget and equipment and a low level of awareness.
