Abstract

The village has the right of origin and traditional rights to regulate and manage the interests of the local community, also helped to reach the purpose offreedom based on Constitution. The Village already regulated base on Indonesian act/law Number 6 of 2014. However, the implementation ofseveral article from the act/law with Registered Number 6 of 2014 does not help and interfering the country to reach its purpose based on its constitution. the constitutional court did a judicial review on an article 25, article 39 and article 48 of act/law Number 6 of 2014. This legal research conducted using a normative method by studying laws and regulations as primary data then supported by literature studies as secondary data. The results of the research show juridical explanations in the judge's considerations based from the Constitutional Court decision with Registered Number 3/PUU-XX/2022 which uses the theory of evidence for the considerations from the Judges in the Decision.
