Abstract
The existence of health law has a very big influence in our nation, especially in the health sector. Nowadays, there are so many medical crimes in the form of malpractice that occurred in society, especially in medical. However, there are still many people who do not know about malpractice. The type of legal research that will be used in this research is empirical legal research. Medical malpractice can be interpreted as an act of negligence, error, or a doctor's lack of ability to handle a disease, resulting in a bad outcome for the patient's treatment. If there is a violation of doctor’s diagnose on his patient, their responsibility will be processed by MKEK and MKDI
