Abstract
Health workers are everyone who specializes in work in the health sector, has adequate knowledge, ability, or expertise, and has studied in the health sector. The health worker profession has a very high risk because of the possibility that patients with disabilities and even die after being treated by health workers. This kind of situation is called a medical risk and this risk is sometimes interpreted by parties outside the health professional profession as medical malpractice. This research is to find out how far the application of the rules contained in Law Number 36 of 2014 concerning Health Workers for nurses who commit medical malpractice to cause death is. The method used in this study is a normative research method that focuses on existing norms and is supported by the results of interviews with judges and representatives of one of the nurses. An analysis was carried out from the data obtained, and conclusions were drawn using the deductive method stating that the criminal sanctions imposed on nurses at the Meulaboh District Court were considered not optimal, so law enforcers must be more thorough and wise in conducting investigations.
