Abstract

Article 19 of the Basic Agrarian Law regulates the implementation of land registration to provide legal certainty and legal protection. Land registration can be carried out if the sale and purchase of land is carried out before the PPAT in accordance with Article 37 Paragraph (1) PP 24 of 1997 where a Deed made by the PPAT will be produced. But in reality it is associated with the District Court Decision No. 28/Pdt.G/2020/PN.Clp sale and purchase between Mr. Sahlan Subarjo and Mrs. Apriliani Mahramah's interest is not carried out before the PPAT and is only proven by a receipt for receiving money. The problem raised is whether the sale and purchase between Ny. Apriliani Mahramah's interest with Mr. Sahlan Subarjo in accordance with the conception of buying and selling land? And what about legal protection for Mrs. Apriliani Mahramah interest as the right holder? The type of research used in this research is normative legal research, with the nature of descriptive research. The data used is secondary data, and using normative analysis methods. How to draw conclusions in this study using the deductive method. The first conclusion from this study is that the buying and selling carried out by Mrs. Interest and Mr. Sahlan are legal when viewed from the material terms of sale and purchase, and are legal according to cash requirements in the concept of Customary Law but are not valid when viewed from the formal conditions of sale and purchase because these conditions are not fulfilled. The second conclusion, Mrs. Interest as a right holder obtains legal protection based on a judge's decision in the District Court Decision No. 28/Pdt.G/2020/PN.Clp because Mrs. Interest is in good faith to register the land in order to obtain legal protection for the land purchased from the sale and purchase transaction
