Abstract

This legal research discusses the issue of applying restorative justice by DIY Police investigators. The purpose of this study is to determine the role of the Yogyakarta Special Region Police in implementing Restorative Justice in traffic accidents. Judging from the type of research, this research is a legal research that uses empirical methods. Data collection was done by interviews and analyzed. The research was conducted at the Yogyakarta Special Region Police Directorate. The results showed that the restorative justice model used was very similar to the Family and Group Conferences model that is often practiced in many countries such as New Zealand, America and South Africa as well as Indonesia. In the implementation of restorative justice, the police act as facilitators. The obstacle faced was the lack of public knowledge about restorative justice and the interests of the victim's family, namely the amount of compensation requested was too large, making it difficult to reach an agreement between the victim and the perpetrator. Based on this, the police can act actively, namely being able to encourage the public to understand Restorative Justice by presenting community elements or community leaders so that the mediation process runs smoothly and succeeds in finding points of agreement and in carrying out their duties the police should not be worried and hesitate in making decisions. Because upholding justice is one of the main tasks of the police
