Abstract

Every indigenous community has customary rights, and so does the Marind Anim community in Merauke Regency, South Papua Province. The Marind Anim customary law community has the right to receive compensation for land acquisition for Mopah Airport, Merauke Regency, South Papua Province. However, during the second compensation payment, the Marind Anim customary law community who had land rights did not receive compensation. In connection with this problem, normative research is carried out, namely focusing on positive legal norms as secondary data as the main data. The payment of compensation to the Malind Anim customary law community was mispaid in the second stage in 2010, this happened because there was an error at the stage of the compensation process that was not by the applicable law. Merauke district government as the person in charge handed over the compensation process in the second stage to team 7 (seven). The obstacle in the compensation process is that the government does not play an active role in the compensation process. Until now the compensation process for the Marind Anim customary law community for customary land is related to land acquisition for the construction of the Mopah Merauke airport in South Papua Province has not been completed, the Malin Anim indigenous people who the right to compensation is still asking the government but there is no definite process.
