Abstract

Indonesia is a country that embraces legal pluralism regarding customary law in every indigenous legal community. This means that customary law is dynamic and constantly interacts with national and international law. Tembawang Tampun Juah Indigenous Forest, owned by the Ketemenggungan Sisang indigenous legal community, located in Segumon Hamlet, Lubuk Sabuk Village, Sekayam District, was designated by the Minister of Environment and Forestry in 2018 based on outdated legislation. Therefore, based on the retroactive principle, this study aims to determine the management of the indigenous forest after the establishment of Tembawang Tampun Juah Indigenous Forest, using normative legal research methods.The research findings indicate that the management of the indigenous forest after the establishment of Tembawang Tampun Juah Indigenous Forest is guided by the Minister of Environment and Forestry Regulation No. 9 of 2021 concerning Social Forestry Management, as well as related regulations regarding protected forest management and areas with protective functions. This is based on the retroactive principle stipulated in Article 198, letter b, of the Ministerial Regulation.One of the challenges in managing the indigenous forest is related to the preparation and marketing of herbal medicines, which require socialization among the indigenous legal community, considering that the state has standards for the preparation and marketing of such medicines.
