Abstract

This thesis focuses on the implications of the public prosecutor's misapplication of the indictment article to the judge's decision in rape cases, with a case study of decision number 892/Pid.B/2021/PN Bjm. The objective of this research is to analyze the compatibility of the indictment article with the material facts presented in the trial and to assess the effects of incorrect determination of the indictment article on the judge's decision in rape cases. Using a normative method with a case approach, this study found that the indictment article presented by the public prosecutor in decision number 892/Pid.B/2021/PN Bjm did not align with the material facts revealed in the trial. The study also identified two significant implications of errors in determining the indictment article: a lighter threat of imprisonment and the invalidity of the indictment due to its failure to meet material requirements. The research is titled "Implications of Public Prosecutor's Misapplication of Indictment Article in Rape Cases (Case Study Number: 892/PID.B/2021/PN BJM)", and provides insights that can contribute to the improvement of legal practices and procedures in rape cases.
