Abstract

Abortion for the rape victim case that happened in the common people is an example that human’s life cannot avoid the evil. The evil development is caused by the increasing of society. The purpose of this research is to know the basic reasons and the law protection for the rape victims doing the abortion. This research uses normative research that focused on the law in the book. The collecting data method used in the research is secondary collecting data method, which can be founded in any literatures and books that connected with the topic. The result of this research is being known that the general reasons to the women who are rape victim do the abortion is because of depression psychological. There is no peace and confidence anymore. Through abortion they want to get their peace, confidence and good future. They can forget their bad experience before. Besides the psychological depression from their selves, they do abortion also because the society depression thinking that their child is an evil result. Now, there is a law protection for rape victims who do the abortion. In Health of laws Amendment number 23 in 1992 claim that there is a substantion changes at chapter 75 in Health Law claiming that for the pregnant woman who is rape victims can do the abortion.
