Abstract

The purpose of this thesis is to find out the strength and analyze the strength of the evidence of the victim witness without an oath in proving the criminal act of sexual abuse against children, to know and analyze the strength of the victim's evidence without an oath, and whether the judge decided in a defeat against the sentence. This research is a normative legal research, using a normative juridical approach. The results of this thesis research show that: First, the strength of the victim's evidence without an oath in proving the crime of sexual abuse of children is not valid evidence but as a guide for judges as referred to in the elucidation of Article 171 of the Criminal Procedure Code. Second, the testimony of the victim witness without an oath in Decision Number 409/Pid.Sus/2018/PN.Tgr is a guide for the judge and is strengthened by other evidence such as documentary evidence in the form of Visum Et Repertum, and evidence of suffering statements admitting the act so that the judge feels that there is enough consideration in imposing a sentence on child abuse in the decision.
