Abstract

This research is based on problems related to considerations in terminating prosecution based on restorative justice in criminal cases of traffic negligence that cause fatalities. This research aims to analyze considerations in terminating prosecution based on restorative justice in criminal cases of traffic negligence that cause fatalities. This research uses normative legal research methods. Termination of prosecution based on restorative justice in criminal cases of traffic negligence that cause fatalities considers the fulfillment of the conditions in the Republic of Indonesia Prosecutor's Regulation Number 15 of 2020 concerning Termination of Prosecution Based on Restorative Justice. Fulfillment of these requirements is explained by the Head of the District Prosecutor's Office to the Deputy Attorney General for General Crimes. Suppose an error occurs in the consideration of the Deputy Attorney General for General Crimes in deciding to terminate a prosecution based on restorative justice. In that case, there is no opportunity for the Head of the District Attorney's Office to correct the error. The Head of the District Attorney should provide a complete and careful explanation of the case title and be allowed to respond to the Deputy Attorney General's considerations for General Crimes.
