Abstract

This study aims to determine: (1) the implementation of Perda DIY No. 3/2013 concerning Management of Household Waste and Household-like Waste and (2) knowing the form of legal protection for communities who are victims of environmental pollution as a result of waste management at the Piyungan TPST, Bantul Regency. This research is included in the study of empirical law. Data collection was carried out by interviews and literature study. Data analysis used qualitative analysis with deductive reasoning methods. The research results show that: (1) the implementation of Perda DIY No. 3/2013 in terms of formulation has been good but not much is in line with practice in the field, especially in the Piyungan TPST. This happened because there was a deliberation that allowed local residents to scavenge and herd livestock, garbage trucks often leaked in the manual transport bins, there was no compensation for residents, and there was no technology that could break down waste quickly with an efficient method. (2) The form of legal protection for victims of environmental pollution as a result of waste management at the Piyungan TPST, Bantul Regency, is to provide compensation in accordance with Article 35 of Perda DIY No. 3/2013 in the form of relocation, environmental restoration costs, health and medical expenses, and other compensation equivalent to the negative impacts arising from household waste management activities and waste similar to household waste.
