Abstract

Criminal cases in Indonesia are often handled slowly. In KUHP chapter 138 (2) of the Criminal Procedure Code, the problem is what if the investigator does not complete the case file to the public prosecutor within 14 days or even the investigator does not complete the case file at all, this will be very detrimental. to the suspect because the law enforcement process against him will be slower, and it is even possible that the case file will not be returned to the public prosecutor because there is a "game" between the investigator and the suspect. This research is empirical research that uses primary data sources obtained directly from interviews with research sources. The data analysis method used qualitative method. The research results show that the principle of fast, simple and low-cost justice has not been fully implemented in the pre-prosecution process, this is because there are no consequences for investigators if within 14 days the investigator does not submit the case files. to the public prosecutor and there are no restrictions on the separation of files from investigators to the public or vice versa. The research results also show that to prevent protracted law enforcement which violates the principles of fast, simple and low-cost justice, the above solution can be implemented, namely increasing the intensity of horizontal coordination between Investigators and Public Prosecutors.
