Abstract

Transportation is an activity that is very vital in human life. Transportation activities give rise to legal relationships or reciprocal relationships between carriers and passengers or owners of goods based on an agreement either in writing or orally. Often the transportation agreement runs improperly, which allows for default and unlawful acts of the parties bound by the agreement. So, the formulation of the problem in this writing is how the legal responsibility of CV. Cahaya Ricky during the transportation process towards the shipper and consignee? This writing is conducted with the aim of knowing how the legal responsibility of CV. Cahaya Ricky during the transportation process towards the shipper and consignee. This writing uses empirical legal research methods, where based on the results obtained that CV. Cahaya Ricky as a transportation company is responsible for the shipment during the transportation process, especially for damage or negligence caused by the carrier. However, it is not responsible for the contents of the shipment because the transportation company only counts the number of goods without checking one by one the contents of the shipment and is not responsible if there is a force majeure situation. Dispute settlement that occurs in the implementation of transportation in CV. Cahaya Ricky will basically try to be fully covered by the carrier. However, for some things that cannot be borne by the carrier, the carrier will resolve the problem through non-litigation (family) channels, especially through negotiations.
