Abstract

Land issues can be said to have never subsided, and even have an increasing trend. Human needs for land are increasing but land is limited causing frequent disputes. This thesis aims to determine the implementation of mediation as an alternative to land dispute resolution at the Yogyakarta City Land Office. The type of research used is empirical legal research. Empirical legal research focuses on social facts, with interview methods as primary data and primary and secondary legal materials as secondary data. Based on data entered at the Yogyakarta City Land Office from 2022 to October 2023, the total number of dispute cases entered reached 18 mediations with the results of 5 agreed and 13 cases disagreed. The settlement is carried out by the Head of Section for Dispute Control and Handling of the Yogyakarta City Land Office. Mediation settlement as an alternative to land dispute resolution at the Yogyakarta City Land Office strives to be in accordance with the governing rules, although sometimes not in accordance with the facts on the ground, and also based on general principles of good governance. The community is familiar with alternative land dispute resolution in the form of mediation, but in the process of implementing mediation there are still often obstacles or inhibiting factors.
