Abstract

Nowadays, there are lots of labors discrimination by job givers. Not only about welfare and prosperity, discrimination is also about health care guarantee. That is why this research entitled THE IMPLEMENTATION OF HEALTH CARE GUARANTEE ON GAS STATION LABORS BASED ON ARTICLE 35 ACT (3) NO. 13/2003 ABOUT LABORS LAW ON 2004-2009 PERIODE AT TERBAN GAS STATION, YOGYAKARTA made to find out how the implementation of health care at Terban Gas Station and also to find out factors that makes labors (as known as Operator) in Terban Gas Station did not get their body protector when they are working. The research made use of empiric law observation method, which is done directly to the research object and informant, and descriptively explained. Researcher also made some questioner and interviews. Those primary data are supported by secondary data obtained from books, positive laws and websites. Since 2006, Terban Gas Station sold half tank of benzene, means 8000 liter every three days. On those days gas station operators need to faces about 2.667 motorcycles equals with 200 cars. When operators inhaling, Timbale as one of benzene ingredient can not be metabolized by the body, so it is accumulate and damage normall cells. Based on those facts, operators at gas station needs to wear body protector, such as mask. But the fact is different. Article 35 Act.(3) is still disobeyed. Labors chose not to wear their mask, because it is not behave if they close their mouth and nose when people talk to them. So, it can be said that Terban Gas Station’s labors does not get their health care guarantee (which is one of JAMSOSTEK program). Based on the result, reasercher gives advice for involved parties such as Labors and Transmigration Department and Health Depatment to do their function as the supervisor optimally. But from all of that, there should be a cooperation between labors and job givers.
