Abstract

In the middle of community life, respect, upholding human rights and protection are still not satisfactory and various cases such as kidnapping, abuse, rape, and even acts of loss of life are often found. Preventing acts of violence is a collective obligation in accordance with Pancasila and the 1945 Constitution of the Republic of Indonesia. The State is of the view that all forms of violence, especially domestic violence, are violations of human rights and crimes against human dignity and take the form of discrimination. Gender differences between men and women with differences in roles and positions as the reality in today's world will not be a problem as long as they are fair. In a positive sense, what every law wants to achieve is gender justice. Law Number 23 of 2004 concerning the Elimination of Domestic Violence was passed because of the many cases of domestic violence experienced by women as weak and helpless characters. However, as time progresses, cases of domestic violence are increasingly diverse and require legal reform without limiting gender or sex so that the rights of every citizen are guaranteed.
