Abstract
House is one the basic needs in human life, but as the number of population keep increasing due to both natural birth factors and due to a lot of people moving mainly to bigger city to try their fortune, the land that available to build houses to fulfill these needs is gradually decreasing, because of this reason humans came up with various innovations to fix these problems, one of the innovations is the idea of a house construction system that built the usual landed house, but will be built above of a building. This legal writing using the basis of primary legal sources of laws that broadly related to Housing and Settlement Areas, Mortgage Rights, Fiduciary Rights, and Goverment regulations regarding flats, as well as secondary legal sources in the form of literature, and journals that have the data to discuss landed houses that built on top of a building as objects in collateral imposition activities, by mainly focusing on what kind of the proof of ownership it has.
