Abstract

A mortgage loan is obtained for various purposes such as starting a business, paying off mortgage installments (Kredit Kepemilikan Rumah or KPR), constructing rental properties, investing in the market, and other financial needs. To secure such loans, one form of collateral is a mortgage right, governed by Law No. 4 of 1996 concerning Mortgage Rights. A mortgage right is a security interest imposed on land rights as defined in the UUPA (Basic Agrarian Law), whether accompanied by other fixtures or not, to ensure legal certainty. Therefore, the mortgage right must be registered. Presently, mortgage rights can be registered electronically through the HT-el system, under Regulation of the Minister of Agrarian Affairs/Head of the National Land Agency No. 5 of 2020 concerning Integrated Electronic Mortgage Services.
