Abstract

The village is not far removed from its relationship with the Village Head. However, the regulations regarding terms of office have been changed several times so that there is a misunderstanding between the prospective village head and the Village Law, resulting in the emergence of konstitutional Court Decision Number 42/PUU-XIX of 2021 concerning Review of Law Number 6 of 2014 concerning Villages. This research method uses descriptive techniques by describing the problem regarding the impact that occurs regarding the periodization of the village head's term of office and the realization of democracy after the Constitutional Court Decision Number 42/XIX/2021 on Village Law No. 6 of 2014. Impact of the Constitutional Court Decision Number 42/2021 PUU-XIX/2021 regarding the realization of democracy in Indonesia is to limit the term of office of village heads to three terms, thereby reducing the potential for absolute power by ensuring that power is not in the hands of one person for too long. And extending the head's term of office has a positive impact, namely that the village head can optimally realize his Vision and Mission for the community. as well as negative impacts, namely the risk of abuse of position power. The impact of this decision on the realization of a democratic state is related to the legal strictness and constitutionality required in a democratic state. The results of the research are that this decision directly places restrictions on the position of village head which is expected to prevent abuse of authority and power by the village head.
