Abstract

Victims of drug abuse are those who unintentionally use drugs due to environmental factors, such as being invited, forced, threatened, or influenced by others to use drugs, and not entirely due to personal desire. Narcotics crime has shown an increasing trend both in terms of quantity and quality of victims, especially among the younger generation such as children and juveniles. Badan Narkotika Nasional (BNN) and Komisi Perlindungan Anak Indonesia (KPAI) consider that adolescents are vulnerable to drug abuse. The purpose of the research is to find out the form of legal protection that can be given to juveniles as victims of narcotics abuse. The type of research used is normative law with data sources, namely primary legal materials containing related laws and regulations and court decisions, as well as using secondary legal materials such as books, news, related legal journals, and intermet. The results showed that legal protection that can be given to juveniles as victims of narcotics abuse is by seeking diversion and providing rehabilitation, both medical and social rehabilitation. The case example presented in this study refers to Decision Number 00/Pid.Sus-Anak/2022/PN Crp, where the judge's consideration in the decision should optimize the interests of the two juvenile defendants who can be categorized as victims of narcotics abuse by seeking diversion and rehabilitation.
