Abstract

This thesis discusses the application of restorative justice based on prosecutor's regulation number 15 of 2020 in traffic accident cases resulting in death, with a normative legal research method that analyzes legal norms. Restorative Justice is the settlement of criminal cases involving perpetrators, victims, and community leaders or community leaders, and the restorative justice process emphasizes restoring the original state rather than retaliation. The purpose of this study is to analyze the implementation of restorative justice based on prosecutor's regulation number 15 of 2020 in traffic accident cases resulting in death. The conclusion of this discussion is that prosecutor's regulation number 15 of 2020 has not yet fully regulated the exception of criminal acts due to negligence from the case requirements determined for restorative justice, in article 5 paragraph (4) only states the exception to the requirements in article 5 paragraph (1) regarding the implementation of restorative justice, so there is no clarity in terms of limitations, procedures, and technicalities regarding these regulations if the settlement of traffic accident cases resulting in death is carried out. Therefore, the follow-up to the discussion is that it is necessary to revise the Prosecutor's Regulation Number 15 of 2020 to clarify the criteria and mechanisms for exceptions to the application of restorative justice in criminal acts committed due to negligence so as to provide legal certainty and prevent multiple interpretations of statutory regulations.
