Abstract

This research aims to understand and analyze the conformity of restorative justice provisions regulated in Supreme Court Regulation Number 1 of 2024 on Guidelines for Adjudicating Criminal Cases Based on Restorative Justice with the principle of case resolution using a restorative justice approach. This research is a normative study with a legislative approach. This research uses secondary data sources from primary legal materials and secondary legal materials. The research findings indicate that the restorative justice provisions in the Supreme Court Regulation Number 1 of 2024 on Guidelines for Adjudicating Criminal Cases Based on Restorative Justice cannot yet be said to fully align with the principles of restorative justice. Considering Article 19 of Supreme Court Regulation Number 1 of 2024 on Guidelines for Adjudicating Criminal Cases Based on Restorative Justice, which stipulates general and specific requirements, if the Defendant does not meet these requirements, the Defendant may be sentenced to conditional imprisonment or supervised release. Regulations regarding conditional sentences or supervised sentences with a maximum of 3 (three) years would be wiser if replaced with fines so that the Defendant's right to freedom is not taken away by the state.
