Abstract

The State Police of the Republic of Indonesia has an authority to eradicate the criminal act of drug in Yogyakarta Povince. One of the legal bases is Law No. 35/2009 of Article 81, stating that “The investigating officer of the State Police of the Republic of Indonesia and the investigating officer of the National Narcotic Agency have authority to make investigation on the misuse and illegal distribution of narcotics and narcotic precursors based on the law.” The eradication of the criminal act of drug in Yogyakarta Province can be done by the Local Police of Yogyakarta Province, Resort Police in Yogyakarta Province and Sector Polices in Yogyakarta Province. It is based on Presidential Regulation No. 52/2010 of Article 3 on Organizational Arrangements and Work Procedures of the State Police of the Republic of Indonesia. To eradicate the criminal act of drug, the Local Police of Yogyakarta Province do a data mapping, coordination with related parties such as Provincial Narcotic Agency, Correctional Institution, Medicine and Health Sector, Drug and Food Bureau, the Forensic Laboratory of the State Police, Customs and Immigration Agency, and make MOU with telecommunication company in accordance with Article 86 (2) of Law No. 35/2009 on Drug, as well as mobilize society to provide any information on the use of drug. The criminal act of drug is mentioned in Consideration at Character d of Law No. 35/2009 on Drug, determining that “importing, exporting, producing, planting, storing, distributing, and/or using drug without tight and accurate control and inspection, and contradictory with the prevailing regulations are the criminal act of drug because they are very harmful and very great dangers for human life, society, nation, and state as well as national security in Indonesia.
