Abstract

This thesis is talking about Implementation Of Verdict The Constitutional Court Number 65/PPU-VIII/2010 About Expanded Definition Of Witnesses In The Criminal Justice Process In Yogyakarta District Court. The court argued that Article 1 number 26 and number 27, Code of Criminal Procedure give limitation and eliminate the opportunity for defendant to present any defense witnesses for them. Under the terms of the Constitutional Court made a breakthrough, where the witness who did not see, did not hear, and did not experience for themselves an incident that can occur testified.The type of this thesis is the normative methods with data collection process through reading and taking notes from books, documents, literature, legal regulations, and the interview. In this thesis, there had been found some results of the research are The Court (Judge), Attorney and advocate was able to execute with good decision although, there are several obstacles that trouble for a judge to decided a criminal case. As the legal considerations in decisions and a de charge witnesses the defendant submitted constrained distances from District Court or a de charge witnesses a public official who could not attend is because his work.
