Abstract

The title of this thesis is The Banking Business Practices viewed in the light of juridical review based on the banking principle, while the research question is whether the bank action in providing the costumer information to the insurance company violates the bank secrecy principal. Further, the objective of the thesis is to know whether that action violates The Banking Law. The type of the research is a normative legal research i.e.areasearch which is conducted or focused on the positive legal norms in the form of preavailing rules and regulations. The data which have been obtained and collected are analyzed qualitatively by understanding it sistematically. Based on such analysis, the conclusion of the research is obtained by employing a deductive method of thinking by extracting conclusion from the general knowledge which later be used to ascertain some specific facts. Finally, based on that analysis, it can be concluded that the action of the bank in providing the bank costumer information to the insurance company does not violate the bank secrecy principal which is regualted whithin the law Number 7 Year 1992 Concerning Banking As Amended by Law Number 10 Year 1998.
