Abstract

Prison is a place where the people conducted the crimes in trespassing law and has been proven as innocent in the court of jurisdiction will be constructed or be guided. Initially the prison is the punishment or sorrow toward the people who have conducted crimes by the shape of execution or forcing works toward the prisoners, Up to now, there are still many treatment which is not humanization are accepted by the prisoners during they conduct the construction in the prison or nowadays more well-known as the name of Socialization Institution. Thus, the author would like to conduct legal research on how above case could be known on the system of prison which then to change into the system of socialization. The author would like to know whether the system of construction which is given to the prisoners nowadays has been penology aspects or socialization. The author selected the IIA class of Socialization Institution Wirogunan Yogyakarta as the location of research to gain primary data as the complementary of secondary data by using method of normative legal research. According to the data or information gained by the officers of the prison in II A Class Socialization Institution Wirogunan Yogyakarta, it is stated that all of construction which is given has been based on the Law Number 12 of 1995 on Socialization. Thus, the construction of the prisoners in II A Class Socialization Institution Wirogunan Yogyakarta has been said as having penology aspect or the socialization, although it has not all of rights of the prisoners such has been stated in the article 14 of Law Number 12 of 1995 on the Socialization has not all been fulfilled yet. By this reason, it needs more consideration from the government in order could give appropriate facilities to the construction of prisoners and also the quality of the officers of the constructer should be increased.
