Abstract
The purpose of this legal research is to know and analyze about the binding power of chapter 158 Act no.13, 2003 after Constitutional Court decided that it was not binding anymore; and to analyze about the suspended workers' rights after Constitutional Court decision. The kind of the legal research, which has been used by the writer, is normative research, which analyzes the valid law norms. The writer has examined literature that was a secondary data, and interviewed several sources. The conclusion of this research is that (1) The legal power of chapter 158 Act no.13, 2003 after Constitutional Court decided that it was not binding anymore based on Constitutional Court Decision No. 012/PUU-1/2003 did not have the legal power because Chapter 10 Act No. 10, 2003 (2) the suspended workers' rights based on chapter 158 Act No. 13, 2003 after Constitutional Court decided that it was not binding anymore, did not have the legal power so it has been given the rights that has been regulated in chapter 160 (7) Act No. 13, 2003, which are the money of altering right and reward money.
