Abstract

This legal writing entitled The effectiveness of Implementing the Distribution of Verification Burden for Public Prosecutor in Judicature of Corruption Criminal Act This legal writing discussed the problems concerning on the effectiveness emerged by verifying system by the shape of providing verification burden or reversed verification that has limited characteristic and equal used by judicature of corruption criminal act to the prosecutor's performance. Corruption criminal act is a extraordinary crime that became other object in this legal research in addition of prosecutor, by the reason of this criminal act is criminal action that threaten state budget as public money and it is also a violation to human rights, i.e. retaking the public/communal rights and can disturb the fluentness of national development. This legal writing was normative juridical research and as consequence data collection it was conducted by literary study method and interview to the source persons relating to the problem understudied. The data from books and other literatures will be used as secondary legal sources. This legal writing was conducted to fording out how extent to the role of prosecutor or judiciary as an institution that has authority to conduct investigation and suing tow the criminal act of corruption. The result of this literary study and interview to source persons, it gained conclusion that the implementation of verification burden distributing system in judicature of corruption criminal act doesn't not have big effects to the prosecutor's performance as the investigator or public prosecutor. It is caused by former before this verification system is ruled in the Republic of Indonesian Laws Number 20 of 2001 on Eliminating of Corruption Criminal Act as the newest laws on corruption; verification has been used in judicature process of real corruption criminal act.
