Abstract

One factor high incidence of trafficking of women in general, due to the promised high-paying jobs outside the area, with the female victims are teens who want to find work. Where, cases of trafficking in persons, especially women who are not humane, the practice of selling a woman from one agent to the next agent. More and more agents are involved, the more posts that will be paid by women, so that their salary was drained by the agents. This phenomenon should be anticipated that such a network can be eradicated and the chain decided through Law No. 21 Year 2007 on Combating the Crime of Trafficking in Persons by first disseminated so that people understand, especially women. This study aims to determine the legal protection of women victims of trafficking and to identify obstacles encountered in providing legal protection for victims of trafficking. The data obtained in the research literature as well as the field is processed and analyzed in a qualitative way, that the analysis of the data based on what was obtained from the literature and the field, either orally or in writing, and directed, discussed and given an explanation with applicable regulations, and concluded with the inductive method, ie draw conclusions from the particular to the general. Conclusion of the study that, the legal protection of women trafficking victims in various ways adapted to the complexity of the crime itself which includes: pre-emptive efforts, preventive, and rehabilitative repressive. Constraints faced in providing legal protection to women victims of trafficking include legal constraints,. Other obstacles include victims of trafficking of women and children come from several factors, including: an increase in demand for migrant workers, the development of an international trafficking network, there still exists the policies that are discriminatory, inadequate quality and quantity of law enforcement, lack of awareness of the law people (victims, families and government officials).
