Abstract

The little of this legal writing is “The Implementation of Alteration (improvement) of Right to Build into Ownership Right on Land for Housing by the Enforcement of KMNA/KBPN Number 6 of 1998 in Tabanan Subdistrict Bali Regency”. Right to Build on housing brings difficulties for low economy society or low income society. The problem is how the implementation of alteration (improvement) of right to build on state land for housing into ownership right in Tabanan Regency and what are the barriers in alteration (improvement) of the right. The type of this research conducted was empirical legal research. Data source was gained from primary data and completed by secondary data and also tertiary data. Data collection was conducted by conducted interview to 32 respondents and five source persons. The research was in Tabanan Regency and two selected subdistricts randomly sampling i.e. Tabanan and Kerambitan Subdistricts. The population totalled 164 persons were the holders of right to build in Tabanan Regency who bought houses by using facility of KPR-BTN. Sample was taken 20% from the population. The data was then analyzed qualitatively. The conclusion was draw using inductive reasoning method. The alteration (improvement) of right to build on housing was conducted without changing the blank. When the application of proposal credit was finished initially then continued with the process of application of alteration (improvement) of right to build in Land Office of Tabanan Regency. Land certificate of ownership right was conveyed to BTN as guarantee and will be returned to the owners after the credit has been amortized. The barriers faced in process of implementation of alteration (improvement) of rights to build on settlement house relates to the conditions of fee and period.
