Abstract

The legal research title is “Judicial Review imposition of the death penalty against people who doing crime with have Dissosiative Identity Disorder (DID). Many reasons that cause people to commit crimes. But appear phenomenon where the crime was commited by those who have a disorder called dissosiative identity disorder. In several cases offenders who have dissosiative identity disorder was sentenced to death. Formulation problem of this research is the imposition of death penalty against people who have dissosiative identity disorder can be justified in law. Normative study was conducted, using secondary data consisting of primary, secondary materials, and tertiary. Research and interview with the resources to obtain information needed by the author, carried outing searching for the source data, the authors also use qualitative methods to think with deductive reasoning in drawing conclusion. Based on the results of this research there are a difference of opinion among experts about criminal responsibility of people who do dissosiative identity disorder so according to expert, law enforcement agencies have mistakenly give the death penalty against people dissosiative identity disorder. But the other side says that people who have dissosiative identity disorder can be held accountable to a crime because dissosiative identity disorder is not severe disorder. However, this is not a reason dissosiative identity disorder offenders can be sentenced to death. Because the death penalty has been proven contrary to the Human Rights.
