Abstract
Legal writing entitle The Implementation of Compensation in Land Acquisition for Ibra Airport Development in The District of Southeast Maluku Based On Presidential Decree Number 36, 2005. This legal writing is discussed whether the implementation of compensation in land acquisition for Ibra Airport development in accordance with the regulations president number 36 2005. Type of applied research is empirical legal research is a sociological study that includes research on the identification of law (not written) and a study of the effectiveness of the law. This study is descriptive analytical that is that in doing research first collected in the general description given by both speakers, respondents and the symptoms that arise from people's behavior and then analyzed by narrowing the scope is specifically related to the procurement of land for development purposes Ibra Airport in Ohoi Ibra. In this study, data were analyzed using a qualitative approach is a way of analysis of the results of research that produces data that is expressed by respondents in writing or orally as well as the behavior of the real, observed and studied as a whole. Used to deduce the inductive method of thinking is a way of thinking that starts from a knowledge that is specific and directed towards aknowledge of a general nature. Conclusion that The Implementation of Compensation in Land Acquisition for Ibra Airport Development in Ohoi Ibra is not in accordance with Presidential Decree Number 36 Year 2005 on Land Procurement for Development Implementation and Regulations for Public Interest KBPN Republic of. 3 of 2007. At the stage of identification and inventory is still there (5 people /15, 15%) the holder of rights to land that is not listed on the contrary there is a name that does not have rights to land in a location Ibra Airport Development. Then there is no Land Price Assessment Team so that the land price appraisal in accordance with the general price of land and is not based on the Tax Object Sale Value of the current year. Deliberative process is also not in accordance with the ordinance because deliberation is done not attended by all holders of rights to land but only a few representatives of local government defined and waiver of the land was not attended by all holders of rights to land also include government agencies that require land. This resulted in the provision of compensation does not impact the development of economic life and even damage the social life of the former holders of rights to land as indemnity cause various problems.
