Abstract

The thesis is to review and analyze farmer rights over the welfare of farmers in indonesian agricultural system of a plant. This is the kind of research literature exclusive that deals with the rights of peasants. The method is the sociology and political legal approach in assessing legal theory of the local wisdom and good governance. The thesis is that research shows. 1) Ignoring the situation in the agriculture sector due to farmers the income of small farmers and the people who are not adequate from the farm production. There has been an increase in armed violence in the agricultural land in the countryside on a serious violation of the rights of peasants. The lost ground the farmers, too, deprived of its authority sovereignty of production and distribution and consumption identity and cultural matters. 2) The constitution number 12 /1992 it has a criminal farmers in java farmers and plant breeders discriminate in west java and there are criminal acts discrimination to farmers and plant breeders in several regions in Indonesian. 3) The constitution number 12 /1992 concerning should be revised, the cultivation of plants it is because the article unconstitutional had an article in the constitution of 1945, act this is a legal product that is green revolution.
