Abstract

A goal of this research is to prove and analyzed the citizen in Yogyakarta got their right for its land law in Special Province of Yogyakarta, moreover to know about its land law based on its race, Chinese. This research use normative legal research. Its research use historical background in Indonesian law to know how the citizen gets its right in Special Province of Yogyakarta, for its native and others; considered on political law in Special Province of Yogyakarta gives justice for all of its citizens based on its characteristic of Special Province of Yogyakarta law. Due this research, characteristic of Special Province of Yogyakarta as well known as in its right to get their private lands; also see while the researcher face some problems and facts where the Indonesian native based on race tries get its rights in laws. Based on research, to get private land must follow some rules because the Kasultanan and the Pakualaman are the two land lord owners in Yogyakarta. Other reason, Special Province of Yogyakarta has instruction for native and native based on race that crash with Indonesian Government’s instruction which is the supreme instruction in Indonesia. It also due in farm land owner and it cause positive discrimination in law.
