Abstract
Legal writng entitled implementation of the third phase of the procurement of land for expansion of the airport in the town of Maumere Frans Seda Sikka Regency of East Nusa Tenggara Province. Writing this law discusses how the implementation of the third phase of the procurement of land for expansion of the airport in the town of Maumere Frans Seda Sikka Regency of East Nusa Tenggara Tmur Province. Type of applied research is empirical legal research is the legal research of identification of the law (nor written) and study of the effectiveness of the law. This study is descriptive analytical that is that in doing research first collected in the general description given by both speakers, respondents and the symptoms that arise from people’s behavior and then analyzed by narrowing the scope is specifically related to the procurement of land for the expansion of the airport third stage Frans Seda in the town of Maumere Sikka Regency Of East Nusa Tenggara Province. In this study, data were analyzed using a qualitative approach is a way of analysis of the results of research that produces data that is expressed by respondents in writing or orally as well as the behavior of the real, observed and studied as a whole. Used to deduce the inductive method of thinking is a way of thinking that starts from a know ledge that is specific and directed to wards a know ledge of a general nature. Conclusion that the implementation of the third phase of the procurement of land for expansion of the airport in the town of Maumere Frans Seda Sikka Flores East Nusa Tenggara Province there is the appropriate and there are not in accordance with Regulation Presidential Decree Number 36 Year 2005 on Land Procurement for Development Implementation and Regulations for Public Interest KBPN Republic of. 3 of 2007. Things that are in accordance with the regulations of the Presidential Decree Number 36 Year 2005 and Regulation KBPN Republic of. 3 of 2007 is the planning phase, the determination of the location, extension, appointment of agency/land price assessment team, at the stage of identification and inventory of appropriate in spite of difficulties in information retrieval and the domicile of one of the holders of ownership rights over the land, which was not domiciled in that location. Things that are not in accordance with the regulations of the Presidential Decree Number 36 Year 2005 and Regulation KBPN Republic of . 3 of 2007 is the process of Deliberation which is not attended by all holders of ownership rights over the land but attended by a representative designated by the local government. Then the appraisal price of land and plant performed a couple of times because the owner of the land did not approve land prices based on local governments raise NJOP so that 50% of the NJOP provisions. This resulted in the provision of compensation does not impact the development of economic life and even damage the social life of the former holders of rights to land as indemnity cause various problems.
