Abstract

In this essay writing, the writer discussed issues on Traditional Drugs Ilegal Distribution by Criminal Legal Ways. This research was aimed to know positive law regulations that could be applied in solving Traditional Drugs Ilegal Distribution and to know law application valid had been suitable with traditional drugs ilegal distribution cases occurred. This research was conducted in Sleman Regency, Yogyakarta by selecting research place in Sleman State Court, Sleman Prosecution Office and Sleman Resort Police and some respondents. Data obtained then was analyzed by comparing actual situation and data on positive criminal laws and traditional drugs distribution resolution and how law application valid for traditional drugs ilegal distribution cases occurred. This research result showed that positive law in solving traditional drugs ilegal distribution was only in Sleman Regional Regulation Number 8 of 2007 on Alcoholic Drink Distribution, Sales and Use Ban that was a local regulation. Sleman Resort Police Office and Sleman State Court were still implementing Sleman Regional Regulations available in solving traditional drugs’ cases. Criminal sanctions charged for traditional drugs ilegal distribution case was fine criminal and prison criminal. In 2013, Sleman State Court charged highest average criminal in Yogyakarta Special Region Court, for lowest fine criminal was Rp 2,000,000 and the highest was Rp 10,000,000, for prison criminal there was still no such charge.
