Abstract
This study, entitled Judicial Review About Punishment Against Children with Kleptomania. This study aims to determine whether the punishment against children with kleptomania who commit theft is right when viewed from the juridical terms. The type of research conducted was a normative study, which focuses on the positive legal norms in the form of legislation. The study was conducted on Gamping II psychologist at the health center and district court judges in Sleman. The results showed that children with kleptomania can not be convicted because Kleptomania is in compliance with Article 44 paragraph (2) as an excuse. Kleptomania child should also be required for treatment in a psychiatric hospital in accordance with Law No. 11 of 2012 on the Criminal Justice System Child Article 82
