Abstract

This research aimed to examine the law effect of the decision of Constitutional Court number 25/PUU-VIII / 2010 against the holder of the mining permit and the impact of Constitutional Court decisions on economic development. This type of research used in this research is a normative legal research. Normative legal research is conducted legal research by examining the library materials or secondary data. The approach used in this research is the approach of law (statute aprroach). Statute aprroach is done by reviewing all laws and regulations relevant to the legal issues. The theory used in this research is a theory about the role of the state. The results showed that the decision of the Constitutional Court number 25/PUU-VIII/2010 does not provide a significant impact on economic development in Kulon Progo Regency. Based on Gross Regional Domestic Product (GRDP) Data in Kulon Progo Regency period of 2005-2009 and the 2009-2013 period, it is known that the business sector contributed most to the total GRDP formation Kulon Progo is the agricultural sector, while the mining sector, including as a sector that provides the smallest contribution to the total GRDP formation Kulon Progo. After the issuance of the decision of the Constitutional Court which has the power of final and binding, not the discovery of mining permit metal mineral exploration in Kulon Progo Regency, for granting mining permit metal mineral exploration in Kulon Progo Regency given prior to the issuance of the decision of the Constitutional Court Number 25/PUUVIII/ 2010. The legal consequences of the mining entrepreneur after the Constitutional Court Decision Number 25/PUU-VIII/2010 is, mining entrepreneur can have a mining permit area metal mineral exploration, with a maximum area of 100.000 (one hundred thousand) hectares, with no minimum limit WIUP 5.000 (five thousand) hectares, thus the mining operators in the province who have less than 5.000 (five thousand) hectares, can obtain a mining permit metallic mineral exploration.
