Abstract

Realization of prisoner’s rights in Indonesia is mentioned in Act No. 12/1995 about society. The rights as a prisoner are related to human rights. The problems that will be discussed in this paper is about how was the realization of the prisoner’s right to convey complains relate to another prisoner’s unpleasant behavior against him or her in penitentiary class IIA Wirogunan and what factors that obstruct that realization. The method that used by this research is based on empirical study where the data obtained from this research are using primary and secondary data. Qualitative analysis is used in this research with inductive thinking method used for the conclusion. According to the analysis that have been done, we can conclude that the realization of prisoner’s right to convey complains relate to another prisoner’s unpleasant behavior against him or her in prison class IIA Wirogunan is not perfectly fulfilled because there many obstacle factors such as the lack of socialization to the prisoners about this rights regulation, there was no working system improvement of the penitentiary that can facilitate overall complains, the lack of monitoring from the supervisory judge. Monitoring of penitentiaryperformance that appropriate with operational procedure must be implemented by the supervisory judge regularly once in three months.
